How We Won This Case

Our client was a 51-year-old heavy equipment operator working on a road construction project on Interstate 70. A serious back injury left him permanently unable to work.

Before contacting our firm, part of his claim had already been resolved. No one had explained that he could still pursue lifetime permanent total disability benefits through the Missouri Second Injury Fund.

Our client was a 50-year-old equipment operator cutting brick pavers with a walk-behind concrete saw. When the saw became lodged, it violently stopped and caused a devastating shoulder injury.

Because of prior shoulder and back conditions, he could no longer work.

We took the case to trial and secured an award ordering the Missouri Second Injury Fund to pay weekly lifetime benefits.

How We Won This Case

Our client was working on Interstate 70 when a drunk driver struck him. He suffered a traumatic brain injury, post-concussive symptoms, and chronic back pain that ultimately required placement of a spinal cord stimulator.

Because of pre-existing conditions combined with the crash injuries, he became permanently unable to work.

We successfully tried the workers’ compensation case and secured lifetime weekly benefits through the Missouri Second Injury Fund.

During our investigation, we also discovered that the drunk driver had no insurance and no assets. We pursued an uninsured motorist claim through our client’s own policy and obtained a policy-limit settlement.
